However, after you read it, you may wish that I had stuck with something less painful (like root canals).&nbsp; In 2008, just before the election I held a webinar called  Higher Taxes Ahead . In that webinar I discussed some of the best guesses that experts were making for what would happen to taxes after the election. Now the time for guessing is over.<br> &nbsp;<br> The Treasure Department has put out the  Green Book on the administration s tax proposals for 2010. It is called the  Green Book simply because that is the color of its cover. The official name is the  General Explanations of the Administration s Fiscal Year 2010 Revenue Proposals. I understand that this maybe far more than you wished to know but it was the only non-depressing item I could include in this e-mail. The completely non-biased (and I really mean it) editor of my tax research software put it this way <strong><span style='font-family:"Verdana","sans-serif"'> the Green Book s revenue raising tax proposals would pose significant tax planning challenges for higher-income individuals, higher taxes for many businesses, and higher compliance costs for business of all sizes .</span></strong>&nbsp; </span><span style='font-size:7.5pt;line-height:115%;font-family:"Verdana","sans-serif"'><o:p></o:p></span></p> <p style='line-height:115%'><span style='font-size:10.0pt;line-height:115%; font-family:"Verdana","sans-serif"'>Significant tax planning challenges is almost an understatement it seems as if the administration wants to make tax planning illegal. The President should listen to what a fellow Harvard graduate, Justice Billings Learned Hand had to say, after all he has been citied more than any other judge by the Supreme Court.&nbsp; Justice Hand s thoughts on the subject were,  There is nothing sinister in so arranging one's affairs as to keep taxes as low as possible. Everybody does so, rich and poor; and all do right, for nobody owes any public duty to pay more than the law demands. <br> &nbsp;<br> Please remember these changes are just proposals for now if you don t like them speak out and perhaps they can be stopped. I will give you the details on the proposals but there a slew of information and you are bound to have a lot of questions so we are going to do a <strong><span style='font-family: "Verdana","sans-serif"'>free teleconference to cover this in greater detail. Beginning 2011, <strong><span style='font-family:"Verdana","sans-serif"'>the highest tax rate will be 39.9%</span></strong> the second highest tax rate would be 36%. Also in 2011, two significant limitations would be imposed on itemized deductions (the deductions for things like home mortgage interest, charitable contributions, state taxes etc.). First <strong><span style='font-family: "Verdana","sans-serif"'>itemized deductions would be reduced by 3%</span></strong> of the amount by which your income exceeds the income limit. On top of that, a taxpayer s <strong><span style='font-family:"Verdana","sans-serif"'>total itemized deductions cannot exceed 28%</span></strong> if the taxpayer would otherwise be at the 36% tax bracket or higher.&nbsp;Beginning 2011, <strong><span style='font-family:"Verdana","sans-serif"'>personal exemptions would be phased out</span></strong> for taxpayers with income in excess of the limit. And a big one for many of us&nbsp;beginning 2011, <strong><span style='font-family:"Verdana","sans-serif"'>a new 20% long-term capital gains and dividend tax rate</span></strong> will apply for taxpayers at the 39.9% regular tax bracket<br> &nbsp;<br> In the  Higher Taxes Ahead webinar I predicted that Alternative Minimum Tax (AMT) would be repealed. I thought this mainly because, due to higher state income taxes, the people most effected by AMT live in Democrat controlled states and now that congress is also Democrat controlled, it looked like there would be some relief.&nbsp; However, this is not going to be the case and it looks as if AMT is here to stay. On the other hand, AMT will be less of an issue for many of us, not because it is going away or being reduced but<strong><span style='font-family:"Verdana","sans-serif"'> because our regular taxes are going up enough to make AMT inapplicable</span></strong>. The administration believes we cannot afford to eliminate AMT. If congress were to eliminate all regular income taxes but leave AMT it would lose less revenue than it would if it eliminated AMT! <br> &nbsp;<br> Another major change comes by way of retirement plans. Beginning January 1st, 2010 all employers who are in business for at least two years that have 10 employees or more and&nbsp;do not have a retirement plan for their employees, would be required to offer an  automatic IRA&quot; option. This would allow for IRA contributions to be withheld from an employee s pay check. Automatic IRA propionates claim that this will be at no cost to the employer. I think they have forgotten to take into account the increased payroll processing costs that are sure to follow. Propionates also tout that employers will not be responsible for providing investment choices for their employees as they are now required to do with 401(k) plans. Instead, <em><span style='font-family:"Verdana","sans-serif"'>(I am quoting right out of the Green Book now, you </span></em><strong><i><span style='font-family:"Verdana","sans-serif"'>just can t make this stuff up</span></i></strong><em><span style='font-family: "Verdana","sans-serif"'>)</span></em>  a low  cost, standard type of default investment and a handful of standard, low-cost investment alternatives would be prescribed by <strong><span style='font-family:"Verdana","sans-serif"'>STATUTE</span></strong> (emphasis added). I can see the investment choices now California or Federal bonds and General Motors, Chrysler or AIG stock.&nbsp; Who is John Galt?<br> &nbsp;<br> There are many other proposed changes that you should be aware of. These changes will affect all businesses (regardless of income), international taxes and investments. The changes not only affect the amount of taxes you may need to pay but they also add new and expanded administrative responsibilities and the related cost to comply to all businesses and many individuals. We will cover these on the conference call but I wanted to leave you with one last change that would have a <strong><span style='font-family:"Verdana","sans-serif"'>major impact</span></strong>&nbsp; on many of our clients.<br> &nbsp;<br> Under the current administration s plan, <strong><span style='font-family: "Verdana","sans-serif"'>virtually all of the tax breaks associated with investment in oil and gas would be eliminated</span></strong>. This will be done in three ways. First, the deduction for intangible drilling costs would be eliminated. Second, the passive loss exception for a working interest in oil and gas properties would be repealed. Third, the percentage of depletion deduction would be taken away. If you are not sure what all of this means, please listen to our conference call.
