(P.L. 111-5) was signed into law on February 17, 2009. As you also know much has been said about how nobody read the Act before it was voted on. Now that it is the law it is finally being read. It differs in several areas&nbsp;from the Federal bill for one, we know for an absolute fact that the California budget was not completely read before it was voted on because it was not yet completely written before the vote! Some of the provisions were presented in concept only, no actual details. There are even three provisions that may apply to your 2008 tax returns. </span></p> <p class=MsoNormal style='margin-bottom:10.0pt;line-height:115%'><span style='font-size:10.0pt;line-height:115%;font-family:"Verdana","sans-serif"'>Before I get into the Act s provisions I should explain some terminology. Many of the tax provisions come in the form of <em><span style='font-family:"Verdana","sans-serif"'>refundable</span></em> <em><span style='font-family:"Verdana","sans-serif"'>credits</span></em>.&nbsp; Many of you already know that a credit differs from a deduction. A deduction reduces your taxable income while a credit is a dollar for dollar reduction of tax. Most credits are non-refundable, which means that they will not reduce your taxes below zero. Refundable credits will reduce your taxes to zero then refund you any remaining credit. </span></p> <p class=MsoNormal style='margin-bottom:10.0pt;line-height:115%'><span style='font-size:10.0pt;line-height:115%;font-family:"Verdana","sans-serif"'>For example John s tax is $500 John has a $750 non-refundable credit. John s $500 in tax is eliminated by the credit and the remaining $250 of the credit is lost. If John s credit were a refundable credit then John s $500 in tax would be eliminated by the credit and the remaining $250 of the credit would be refunded to John. With refundable credits it is possible for people who had <u>no withholding</u> and <u>paid in no tax</u> to get a <u>refund</u>. </span></p> <p style='line-height:115%'><span style='font-size:10.0pt;line-height:115%; font-family:"Verdana","sans-serif"'>There is one provision for individuals that can affect your 2008 tax return, the <strong><span style='font-family: "Verdana","sans-serif"'>Homebuyer Credit. </span></strong>If you buy a home in 2009 on or before November 30, 2009, you can get a federal tax credit of up to 8,000.This is a credit so it increases the amount of your refund. Better yet, even though you buy a home in 2009, you can report it on your 2008 return and get the refund fast. See our summary for more details and who is eligible.&nbsp;&nbsp;</span><span style='font-size:9.0pt;line-height: 115%;font-family:"Calibri","sans-serif"'> <o:p></o:p></span></p> <p style='line-height:115%'><span style='font-size:10.0pt;line-height:115%; font-family:"Verdana","sans-serif"'>There are two provisions for businesses that can affect your 2008 tax return, the net operating loss carry back and a reduction in estimated tax payments for business owners.&nbsp;&nbsp;&nbsp;</span><span style='font-size:9.0pt;line-height: 115%;font-family:"Calibri","sans-serif"'> <o:p></o:p></span></p> <p style='line-height:115%'><strong><span style='font-size:10.0pt; line-height:115%;font-family:"Verdana","sans-serif"'>Net operating losses for small businesses carry back </span></strong><span style='font-size: 10.0pt;line-height:115%;font-family:"Verdana","sans-serif"'>an eligible small business with a net operating loss generated in years beginning or ending in 2008 may choose to first carry a net operating loss back 2 years, 3 years, 4 years, 5 years or not carry it back at all. <strong><span style='font-family:"Verdana","sans-serif"'>&nbsp;</span></strong></span><span style='font-size:9.0pt;line-height:115%;font-family:"Calibri","sans-serif"'> <o:p></o:p></span></p> <p class=MsoNormal><strong><span style='font-size:10.0pt;font-family:"Verdana","sans-serif"'>Estimated tax payment requirement eased for small business owners </span></strong><span style='font-size:10.0pt;font-family:"Verdana","sans-serif"'>For 2009, an individual who is a small business owner may avoid the underpayment penalty if that individual makes estimated tax payments equal to the lesser of 100% of the tax shown on the return or 90% of the tax shown on the return for the preceding year.
